江苏省高院出台意见:不安排年假,单位得赔3倍工资

  中國江蘇網訊 記者12日從江蘇省高級人民法院獲悉,為全面落實帶薪年休假制度,保障勞動者休息休假的權利和促進企業的長遠發展,正確審理年休假爭議案件,根據《中華人民共和國勞動合同法》等相關規定,該院出臺審理帶薪年休假糾紛若幹問題的指導意見。

  根據指導意見,勞動者與用人單位因支付未休年休假工資報酬而發生爭議的,人民法院應予受理。對於公眾關註的“未休年假賠3倍工資”,意見明確,用人單位未安排年休假,勞動者主張按其日工資收入300%支付未休年休假工資報酬的,法院將予以支持。未休年休假工資報酬的日工資收入按照勞動者本人的月工資除以月計薪天數進行計算,月工資是指勞動者應休假年度的月平均工資,包含獎金、津貼等工資性收入,不包含加班工資。如果用人單位與勞動者對未休年休假工資報酬計算標準有約定的,從其約定,但該約定不應低於日工資收入。但是用人單位已安排年休假,且能舉證證明系因勞動者本人原因未休的,勞動者要求支付年休假工資差額的,法院不予支持。

  目前,該意見已開始施行。江蘇省高級人民法院之前有關規定與本意見不一致的,不再適用。
